These Terms & Conditions ("Terms") govern your access to and use of Zaptium, a service that automates replies to Instagram comments and direct messages. Zaptium is operated by Zaptium Technologies LLP, a limited liability partnership incorporated in India (LLPIN ACZ-6920), with its registered office at P.No. 60, Manglam City Ext, Hathoj, Jaipur, Rajasthan 302012, India (GSTIN 08AAEFZ5141R1ZG; PAN AAEFZ5141R) ("Zaptium", "we", "us", "our"). These Terms form a binding agreement between Zaptium and the individual or business that creates an account ("you", "your").
Please read these Terms together with our Privacy Policy, which explains how we handle personal data, and our Data Processing Agreement, which governs personal data we process on your behalf when you use lead capture.
1. Acceptance of these terms
By creating an account, connecting an Instagram account, or otherwise using Zaptium, you confirm that you have read, understood and agree to be bound by these Terms, the Privacy Policy and the Data Processing Agreement.
If you are using Zaptium on behalf of a business or other organisation, you confirm that you have the authority to accept these Terms on its behalf, and "you" means that organisation. If you do not agree to these Terms, do not use the service.
2. What Zaptium is
Zaptium connects to your Instagram Professional account through Meta's official Instagram Platform APIs and lets you configure automations — for example, replying to a comment with a link, answering common questions, capturing leads, issuing coupon codes, or directing people to a booking page. You decide which automations exist, what they say, which accounts they run on, and when they are active.
Zaptium also provides a lead CRM, a priority inbox for conversations that need a human, a link-in-bio page builder, a knowledge base used to ground automated answers, and workspace analytics. Available features depend on your plan.
Zaptium is an independent product. It is not affiliated with, endorsed by, sponsored by, or otherwise associated with Meta Platforms, Inc., Instagram or Facebook.
3. Accounts, workspaces & eligibility
- You must be at least 18 years old, or the age of majority in your jurisdiction, to use Zaptium.
- You must provide accurate registration information and keep it current.
- You may create an account with an email address and password, or by signing in with Google. Where you sign in with Google, we receive only basic identity details from your Google account — never a password, and never access to any other Google service. What we receive and how we use it is set out in our Privacy Policy, and your use of Google's sign-in service remains subject to Google's own terms.
- You are responsible for keeping your credentials secure and for all activity that occurs under your account. Tell us promptly at security@zaptium.in if you believe your account has been compromised.
- Your data in Zaptium is organised into a workspace. A workspace is the boundary that owns your connected Instagram accounts, automations, leads, knowledge sources and subscription. A workspace may have one or more members; any member can act within it, and their acts bind the workspace.
- Acceptance of these Terms, the Privacy Policy and the Data Processing Agreement is recorded at the level of the workspace. Where any active member of a workspace accepts an updated document, that acceptance binds the workspace.
4. Connecting your Instagram account
To use Zaptium you must connect an Instagram Professional (Business or Creator) account. Personal Instagram accounts are not supported.
You authorise Zaptium directly with Meta using Meta's official authorisation flow. You never share your Instagram password with Zaptium. We request only the permissions needed to read and respond to comments and messages on the accounts you connect, and we use the resulting access solely to provide the service to you. You may disconnect an account at any time, which stops further automation on it.
Your use of Instagram remains subject to Meta's own terms and policies, including the Instagram Platform Terms and Meta's developer policies. We are not responsible for changes Meta makes to its APIs, permissions, review requirements, rate limits, policies or availability, any of which may change or interrupt how Zaptium works. Where Meta restricts, disables or removes access to an account or to our platform integration, we may be unable to deliver some or all of the service.
5. Acceptable use
You agree to use Zaptium lawfully and in line with Meta's and Instagram's rules. You must not:
- Send spam, bulk unsolicited messages, or content that is misleading, deceptive or harmful.
- Use Zaptium to harass or abuse anyone, or to infringe anyone's rights.
- Attempt to bypass Instagram's messaging windows or rate limits, or the safeguards Zaptium applies to protect your account.
- Send or store content that is unlawful, infringing, hateful, or sexually exploitative.
- Configure lead capture to collect personal data from anyone under 18, or to collect data for a purpose other than the one you disclose.
- Use lead data — including data you export — for any purpose other than the one the person consented to.
- Reverse engineer, resell, sublicense or misuse the service, probe or interfere with its operation, or attempt to access another workspace's data.
- Use the service to build or train a competing product, or to benchmark it for public disclosure without our written consent.
Zaptium is designed to operate within Instagram's limits, including respecting messaging windows and sending only the replies Instagram permits. Attempting to work around these protections is a material breach of these Terms.
6. Your content and data
You retain ownership of the content you create in Zaptium and of the messages sent through it. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit and display that content solely to the extent needed to operate and support the service for you, and to comply with law. This licence ends when the content is deleted, subject to backup rotation described in the Data Processing Agreement.
You are responsible for the content of your automations, replies and knowledge sources, and for having the rights necessary to use them. We do not review your content before it is sent, and you remain responsible for what is sent from your Instagram accounts.
We do not sell your data, and we do not use content you store in Zaptium to train or fine-tune machine learning models.
7. Automated and AI-assisted features
Some Zaptium features use third-party generative AI models to classify incoming messages, extract the field values you have configured, and draft answers grounded in the knowledge sources you provide. Where these features are used:
- Output is probabilistic and may be wrong. Automated answers are generated from your knowledge sources and may be inaccurate, incomplete or unsuitable. You are responsible for reviewing your configuration, setting appropriate confidence thresholds, and monitoring what your automations send.
- Zaptium applies safety checks and routes low-confidence cases to your priority inbox for a human instead of answering automatically, but these controls reduce rather than eliminate the risk of an unsuitable reply.
- Before personal data is submitted to an AI model for field extraction, values we detect are replaced with opaque tokens, and detokenisation happens within Zaptium.
- That detection is automated, pattern-based and best-efforts — it is not exhaustive. A value written in an unusual format, in words rather than digits, or in a pattern we do not recognise may go undetected and be transmitted to the model provider in its original form. Message content sent for classification and answering is not tokenised at all. You must not configure automations to ask for payment card details, Aadhaar or other government identifiers, financial account details, or health data, and you are responsible for the categories of data your configuration causes to be collected. Section 4.3 of the Data Processing Agreement sets this out in full.
- Our AI provider is listed in the Data Processing Agreement, which also states where that processing takes place.
You must not rely on AI-assisted output for legal, medical, financial or other advice, and must not configure it to give such advice on your behalf.
8. Lead capture and your data-protection role
When you use Zaptium to collect personal data from members of the public through Instagram — names, phone numbers, email addresses or other fields you configure — you are the Data Fiduciary (controller) for that data and Zaptium is your Data Processor. The Data Processing Agreement governs that relationship and forms part of these Terms.
In particular, you are responsible for stating an accurate collection purpose, for asking only fields necessary to that purpose, for maintaining your own privacy notice at a working URL, for setting a retention period, and for handling any request or complaint that reaches you directly. Zaptium displays the notice you configure, records consent, enforces your retention period, and provides the people who submit data with a page where they can view and delete it.
9. Plans, billing, taxes & refunds
- Zaptium offers a free plan and paid plans. Plan prices, feature entitlements and usage limits are shown before you subscribe and are enforced by the service.
- Payments are processed by our payment provider. We do not store your full card details.
- Prices are stated in Indian Rupees and are exclusive of applicable taxes unless stated otherwise. Goods and Services Tax is applied at the prevailing rate and shown on your invoice. If you supply a GSTIN, it is your responsibility to ensure it is accurate and belongs to your business.
- Paid plans renew automatically at the end of each billing period until cancelled. You may cancel at any time from your workspace's billing settings; cancellation takes effect at the end of the current paid period, and you keep access until then.
- Fees already paid are non-refundable except where required by law or where we expressly agree otherwise in writing. We do not provide pro-rata refunds for partial periods or for periods in which you did not use the service.
- If a payment fails, we may retry it and may suspend paid features until payment succeeds. Persistent non-payment may lead to downgrade or termination under section 12.
9.1 Changing your plan
The price of a subscription is fixed for the life of that subscription. We do not change the price of a plan you are already subscribed to.
Changing plan does not modify your existing subscription — it creates a new one and ends the old one. In practice:
- Upgrading to a more expensive plan takes effect immediately. We charge a prorated top-up for the remainder of your current billing period, calculated from the difference between the two plans' daily rates. That top-up is charged in full at checkout and is non-refundable. Your new plan's regular billing cycle begins when your current period would have ended, so you are never charged twice for the same days.
- Downgrading to a cheaper plan, or switching billing interval at the same or lower price, takes effect at the end of your current billing period. You keep your current plan and its features until then, and nothing further is charged at the time you make the change. Your payment provider may place a small verification hold to authorise the new subscription; it is refunded automatically.
- Moving to the free plan is a cancellation rather than a plan change. Your paid features continue until the end of the period you have paid for, after which your workspace reverts to free-plan limits.
- If you start a plan change and do not complete payment, nothing happens: your current plan, its features and its renewal date are untouched.
9.2 If we discontinue a plan
We may stop offering a plan, or replace it with a different one. If we discontinue a plan you are subscribed to, we will give you notice and a reasonable period in which to move to another available plan. If you have not moved to another plan by the end of that period, we will cancel your subscription at the end of the period you have paid for, and your workspace will revert to free-plan limits. You may then subscribe to any plan we offer at its then-current price. We will not migrate you to a different plan or a different price without your agreement.
9.3 Plans we grant you
We may, at our discretion, grant your workspace access to a plan without charge — for example for a trial, a partnership, promotional access, or support purposes ("admin-granted plan"). An admin-granted plan is not a paid subscription: it carries an expiry date set when it is granted, and your workspace automatically reverts to the free plan when that date passes.
- We may revoke an admin-granted plan at any time, for any reason. Revoking it reverts your workspace to the free plan. Because nothing was paid for an admin-granted plan, no fee is charged or refunded when it is revoked or expires.
- You may also cancel an admin-granted plan yourself at any time, from your workspace's billing settings. Unlike cancelling a paid plan, this takes effect immediately rather than at the end of a billing period, since an admin-granted plan has no billing period.
- If you subscribe to a paid plan while an admin-granted plan is active, the paid subscription replaces it immediately, and you are charged the plan's full price at checkout, the same as a first-time subscription.
10. Availability, limits & changes to the service
We work to keep Zaptium available and reliable, but we do not guarantee uninterrupted or error-free service and we do not offer a service-level commitment on any plan unless separately agreed in writing.
We may add, change or remove features over time. We may also pause, throttle or limit automations and outbound sending where needed to stay within Instagram's rate limits, protect your connected account from restriction, protect other customers from the effects of shared platform limits, or maintain the service. Where we defer sending for these reasons, messages are held and retried rather than discarded, subject to Instagram's messaging windows.
11. Changes to these terms
We may update these Terms, the Privacy Policy and the Data Processing Agreement from time to time — for example to reflect new features, a change of sub-processor, or a change in law.
When we publish a new version, we assign it an effective date and show it to you in the app before that date arrives. How a change takes effect depends on how significant it is:
- Informational changes — clarifications, corrections and similar non-material updates. We show you a notice in the app. Your continued use of Zaptium after the effective date means you accept the updated document.
- Changes requiring your acceptance — material changes, including changes to fees, liability, dispute resolution, the purposes for which data is processed, or the terms on which we process personal data on your behalf. We give you at least 30 days' notice before the effective date, together with a summary of what has changed and a link to both the new and the previous version. You may accept at any point during that period.
If you have not accepted a change requiring acceptance by its effective date, we may restrict your workspace's use of the service until you do. Where we do this, we will always continue to let you read the updated document, accept it, manage your billing, and delete your account. While your workspace is restricted you cannot change its automations, inbox, rules, knowledge sources or bio pages, but you can still view, update and export your leads. If you still have not accepted, we may then suspend your workspace under section 12; a suspended workspace cannot export or change its data, so export anything you need before then. We will not send messages from your Instagram accounts on your behalf while your workspace is restricted in this way.
If you do not wish to accept a change, you may cancel your subscription and stop using Zaptium before the effective date. Your workspace's acceptance history, including which version was accepted and when, is available to you in your workspace settings.
12. Suspension & termination
You may stop using Zaptium at any time, and may delete your account and associated data from within the app or by writing to privacy@zaptium.in.
We may suspend or terminate your access, in whole or in part, where:
- you breach these Terms, including the acceptable-use rules in section 5;
- your use of the service is, or we reasonably believe it to be, unlawful — including configuring lead capture to collect personal data from children, or using lead data for a purpose the person did not consent to;
- we are required to do so by Meta's policies, by law, or by a competent authority;
- your payment is overdue after we have given you notice; or
- your workspace has not accepted a document that requires acceptance, as described in section 11.
Except where a breach is serious, unlawful, or we are legally required to act immediately, we will give you notice and, where the breach is capable of being fixed, a reasonable opportunity to fix it. On termination, your right to use the service ends. You may export your data while your workspace is active, including while it is restricted under section 11; a suspended workspace cannot export. We will delete or de-identify your data as described in the Privacy Policy and the Data Processing Agreement.
13. Disclaimers & limitation of liability
To the fullest extent permitted by law, Zaptium is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the service will be uninterrupted, secure or error-free, that automated or AI-assisted output will be accurate or suitable, or that the service will remain compatible with Instagram or with Meta's platform.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, data or business opportunity, however caused.
To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with these Terms and the service, whether in contract, tort (including negligence) or otherwise, is limited to the amount you actually paid to Zaptium for the service in the twelve months immediately before the event giving rise to the claim.
We are not liable for losses arising from Meta's acts or omissions, including changes to its APIs or policies, rate limiting, or the restriction, suspension or removal of your Instagram account. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence.
14. Indemnity
You will indemnify and hold Zaptium harmless against claims, damages, losses and reasonable costs (including legal fees) arising from your content, your automations, your use of the service in breach of these Terms or applicable law, or your handling of personal data you collect through the service — including any claim by a person whose data you collected, or any proceeding brought by the Data Protection Board of India in respect of your processing.
15. Governing law & general
- These Terms are governed by the laws of India. The courts at Jaipur, Rajasthan have exclusive jurisdiction over any dispute arising out of or in connection with them, and you and we each submit to that jurisdiction.
- Before starting proceedings, each party will first raise the matter in writing with the other and attempt in good faith to resolve it within 30 days.
- You may not assign or transfer these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets, on notice to you.
- If any provision of these Terms is held unenforceable, the rest remains in force and the unenforceable provision is modified to the minimum extent needed to make it enforceable.
- Our failure to enforce a provision is not a waiver of it.
- These Terms, together with the Privacy Policy and the Data Processing Agreement, are the entire agreement between you and Zaptium in respect of the service, and supersede any prior understanding on the same subject.
- Neither party is liable for failure to perform caused by events beyond its reasonable control.
- Sections 6, 13, 14 and 15, and any accrued payment obligation, survive termination.
